Terms & Conditions
1. Conditions of Carriage/Contract
Brindabella Airlines passengers fly subject to
these terms and the laws of the Commonwealth,
States and Territories.
2. Limitation of Liability
Brindabella Airlines flies wholly within Australia.
Subject to the provisions of the Trade Practices
Act 1974 (Cth), the Civil Aviation (Carriers’
Liability) Act 1959 (Cth) and applicable State
and Territory legislation liability is limited
as follows:
- • In respect of the death or injury of any passenger - $500,000.00;
- • In respect of checked baggage - $1,600.00 per passenger and
- • In respect of cabin baggage - $160.00 per passenger.
Liability for breach of any provision or term
implied by Division 2 of Part V of the Trade Practices
Act 1974 (Cth) or equivalent state legislation
whose operation cannot be excluded is limited
to the extent possible to:
- • Resupply of the services; or
- • Payment of the having the services supplied again.
3. Check-In Requirements
Passengers are required to be checked-in and ready
for boarding 30 minutes prior to the scheduled
departure time. Photo identification must be produced
by the passenger at the time of check-in. Passengers
that fail to check in 15 minutes prior to the
scheduled departure time will be denied carriage
and rebooked on the next available flight. Passengers
that fail to check in by the scheduled departure
time shall be rebooked or refunded in the absolute
discretion of Brindabella Airlines.
4. Cabin/Carry on Baggage Allowances
Passengers may carry items including the following
free of charge provided such items do not exceed
3 kgs:
- • Handbag, pocket book or purse which is appropriate
to normal traveling dress and is not being used
as a container for the transportation of articles
which would otherwise be classed as baggage;
- • An overcoat, wrap or blanket;
- • An umbrella or walking stick;
- • A small camera and/or pair of binoculars;
- • A reasonable amount of reading matter for the flight;
- • Infant's food for consumption in flight;
- • A pair of crutches and/or other prosthetic device
for the passenger's use provided that the
passenger is dependant upon such device, may be
used for boarding but are to be stowed in the
aircraft hold;
- • All other articles including overnight bags,
briefcases, personal computers, vanity cases,
cameras etc subject to the aforementioned limit
of 3 kgs and not exceeding 48cm (w) x 34cm (h)
x 23cm (d) and the condition that aircrew may
direct that some of these items be stowed in aircraft
lockers;
- • Wheelchairs may be used for boarding but are
to be stowed in the aircraft hold.
5. Checked Baggage
Passengers (except infants) are allowed baggage
not exceeding 10 kgs in weight 48cm (w) x 34cm
(h) x 23cm (d). Brindabella Airlines will carry
excess baggage on a space available basis, and
there may be a fee charged.
Any lost or damaged baggage must be reported to
Brindabella Airlines in writing as soon as practicable
after discovery of the loss or damage.
6. Other Service Provides/Means of Transport
Brindabella Airlines may, without notice, substitute
means of transport or service suppliers. These
terms and conditions apply to any substituted
or altered means of transport or service suppliers.
7. Insurance
Personal and baggage insurance is recommended.
Further information with respect to insurance
can be obtained from Brindabella Airlines or your
travel agent.
8. Government & Other Taxes and Charges
Your ticket price may include government and other
taxes, charges and fees. These fees are imposed
by entities including government authorities and
airport operators. These taxes, charges and fees
may constitute a significant portion of the cost
of your total fare.
9. Smoking
Smoking is not permitted on any Brindabella Airlines,
aircraft or at airport terminals.
10. Conduct During the Flight
Passengers must comply with the following requirements
and all other directions of any Brindabella Airlines
crew member. When on board;
- • Seatbelts must be fastened when seated;
- • Passengers must remain seated when directed particularly while the aircraft is moving on the tarmac;
- • Electronic devices that may interfere with the flight must not be operated;
- • Smoking is prohibited (see 9 above);
- • Alcohol may only be taken if served by Brindabella Airlines;
- • Infant and child restraints must be used as directed; and
- • Passengers must generally behave in a matter to which other passengers may not reasonably object.
11. General Discretion to Deny Boarding
If, in the opinion of Brindabella Airlines or
its agents, a passenger is in breach of the conditions
of carriage or under the influence of drugs or
alcohol or that it is necessary for the safety,
comfort or security of other passengers or the
protection of property, Brindabella Airlines reserves
the right to refuse carriage and may deny the
passenger boarding or require the passenger to
leave the aircraft or other means of transport
and may if necessary physically remove the passenger
from the aircraft or other means of transport
or physically restrain the passenger.
12. Dangerous Goods
The following restricted articles must not be carried in your baggage:
- • Compressed gases e.g. refrigerants;
- • Non flammable and poisonous substances such as butane and aqualung cylinders;
- • Corrosives including acids, alkaline, mercury, and wet cell batteries;
- • Explosives, munitions, fireworks and flares;
- • Flammable liquids and solids including lighter or heating fuels, matches, paints or other easily ignited articles;
- • Infectious substances including live virus, blood, radioactive materials or any other poisons including insecticides and weed killers;
- • Medicines and toiletries in excess of that required for personal use;
- • Alcoholic beverages in excess of 2 lts or 2 kgs;
- • Firearms or weapons of any description.
Passengers shall not tender dangerous or potentially
dangerous goods for carriage as baggage. You must
not include in checked baggage:
- • Fragile, delicate or perishable items;
- • Medicine;
- • Money, jewellery, precious metals, silverware;
- • Negotiable papers, securities or other valuables (e.g. cameras and electronic equipment);
- • Commercial goods or documents; or Passports or other travel documents.
Provided such items comply with applicable size
and weight limitations they may b e carried on
you or with you as cabin/carry on baggage under
your care. Brindabella Airlines accepts no liability
for loss of, damage to or delay in delivery of
such items.
The passenger is not permitted to carry any sharp
objects in his/her cabin, carry on baggage such
as nail files, scissors, manicure kits, letter
openers, pocket knives etc. Such items must be
placed in checked baggage only.
13. Searches
Brindabella Airlines, government or airport officials
may require you to submit to clothing and body
searches, or require you to submit your baggage
to searches or inspections, and search or inspect
your baggage with or without you.
14. Warsaw Convention
If the passenger's journey involves an ultimate
destination or stop in a country other than the
country of departure, the Warsaw Convention may
be applicable and the convention governs and in
most cases limits the liability of carriers for
death or personal injury and in respect of loss
of or damage to baggage.
15. Passenger Health
If the passenger has any concern as to well being
in flight, Brindabella Airlines recommends that
he/she consult his or her doctor before travel
and follow the health advice provided by his/her
doctor. In particular, pregnant passengers are
encouraged to consult their doctors particularly
where there is a complicated pregnancy. Passengers
are also advised that studies have concluded that
prolonged immobility may be a risk factor in the
formation of clots in the legs, deep vein thrombosis.

on exercise to avoid deep vein thrombosis.
